The Committee’s work plan for the next year is not a secret. It is an official document approved by the decision of the Committee members and posted on the official website of the Verkhovna Rada. It includes 10 priority legislative initiatives, said Mykhailo Radutskyy

1.On Amending Certain Legislative Acts of Ukraine to Improve the Provision of Medical Care Using Telemedicine.

The development of technology today allows a doctor from a frontline medical center in Zaporizhzhya to consult with a professor in New York. However, we still do not have a separate law that would regulate the issue of telemedicine application and patients’ access to modern methods of diagnostics and treatment using digital technologies. The bill will allow more effective use of telemedicine in Ukraine.

(2) On Amending the Law of Ukraine “On Protection of the Population from Infectious Diseases”

3. on Biosafety and Biological Defense.

Last year, the Parliament adopted the Law on the Public Health System. We continue to update legislation related to biological safety and countering the spread of infectious diseases. It is also important that these two draft laws will regularize Ukrainian legislation into the relevant provisions of EU law.

4. About medical devices

The government has developed a relevant draft law, which has already been registered in Parliament (No. 7585). Currently, the text of the document is imperfect – it does not take into account the changes in technical regulations adopted in the EU. Therefore, it will be finalized so that it complies with the updated EU norms and is supported by the main market stakeholders.

5. On regulating the circulation of cannabis plants (Cannabis) for medical, industrial purposes, scientific and scientific-technical activities in order to create conditions for improving access of patients to necessary treatment for cancer and post-traumatic stress disorder resulting from war.

Bill No. 7457 was drafted by the Ministry of Health. The legalization of medical cannabis is especially relevant now, when hundreds of thousands of Ukrainians have post-traumatic stress disorder. According to the forecast of the Ministry of Health, after our victory, the number of Ukrainians with PTSD may reach up to 3 million people.

6. On assisted reproductive technologies

After numerous scandals with children from surrogate mothers, we decided to develop a separate law protecting the rights of children and parents. Three alternative bills (#6475, #6475-1, #6475-2) have been registered in the Verkhovna Rada of Ukraine. Based on the results of their consideration at the meeting of the specialized subcommittee, we decided to create a working group to develop a new agreed version of the bill. We plan to submit to the Verkhovna Rada the committee version of the document, the main author of which is our colleague Victoria Wagner.

7. On the regulation of the circulation of special food products, biologically active additives and other food supplements

Today, to sell dietary supplements in Ukraine it is enough to obtain a sanitary certificate. Biological supplements can harm people’s health, so it is necessary to organize state control over their registration and bring our legislation in this matter closer to the provisions of EU law.

8. On self-governance of medical professions in Ukraine

The parliament rejected the first committee version of the bill, which had been drafted at numerous meetings for two years. This time the law was developed by the Ministry of Health and now the document is being discussed with the industry stakeholders. But in Ukraine, as in the EU countries, there should be developed self-governance of medical processions, which will be delegated a number of powers in the field of health care.

These two bills would address issues related to the effects of warfare.

What else was important?

Parliamentarians debated most of all about Law No. 2271 on restricting the circulation of medicines, the production of which is located in the territory of the Russian Federation or the Republic of Belarus, as well as on the export of medicines from Ukraine.

Not everything was taken into account. The AMCU provided the Ministry of Health with recommendations on medicines produced in Russia

We shall remind you that the import of medical products from the aggressor country and the country assisting it is prohibited by a decree of the Health Ministry. However, medicines produced by international pharmaceutical companies at factories in Russia and Belarus can enter Ukraine. Bill No. 7313 gives the Ministry of Health the authority to cancel the registration of a registration certificate if at least one component or stage of production was carried out in these countries. In my opinion, the adoption of the law by the Verkhovna Rada is another signal to international pharmaceutical companies that they should withdraw from the Russian market and not continue to finance the war in Ukraine because of taxes.

The process of deregistration should be transparent. Recently, the NACC and the Ministry of Health held a working meeting to discuss changes in the procedure for deregistration. Suggested that the Committee, the Ministry of Health and the American Chamber of Commerce, as representatives of business, hold a joint meeting to discuss changes to the bylaws.
